1. BACKGROUND

General / contractual performance

The general terms and conditions (GTC) apply to all products, services and deliveries that are purchased from black & schweiz (“we” / “us”). By submitting an order, you (the “customer”) expressly agree to these terms and conditions. The general conditions only apply to customers who are consumers.

Individual subsidiary agreements are only valid if there is a written confirmation from black & Switzerland.

2. CONTRACT

A purchase contract is concluded when the customer has received an automated order confirmation from black & Switzerland by email. With this email confirmation, the purchase contract is concluded and changes and cancellations can no longer be accepted at this point in time.

The customer must be at least 18 years old to place orders through the website. black & schweiz does not accept credit purchases for persons under the age of 18. We reserve the right to refuse a customer's order (for demonstrable reasons).

We only accept orders and delivery addresses within Switzerland.

3. COPYRIGHT

The author of the photographs and products offered on black & switzerland is black & switzerland itself or the partner of the frame. The delivered end product is therefore free of third party rights.

By purchasing a product with the content of the photographs made available on black & schweiz, the customer only acquires the real property of the product. Rights of use for reproduction of any kind, distribution, processing or making available to the public are not included and are absolutely prohibited.

4. OFFER AND PRODUCTS

The prices in our offers and order confirmations are in CHF (Swiss Francs) and are generally binding. The prices include payment and shipping charges.
black & schweiz is not subject to value added tax.

It is our aim that our products are depicted as realistically as possible. The product images can differ from the actual product, depending on which screen is used and which color settings are stored. They are of a purely informative nature. Nevertheless, we strive to depict our products as realistically as possible. In particular, no liability can be assumed for the correctness, completeness and topicality of the information. black & schweiz reserves the right to change prices and ranges at any time.

We print our prints on 200 g uncoated premium paper with a smooth surface.

Our picture frames are available in three different sizes. The specified dimensions refer to the internal dimensions of the frame. The external dimensions of all frames can be reported by email on request. The frame is made of wood and is black. The frames in size 20x30cm have an integrated support so that they can be placed on a shelf, for example. All frames are designed in such a way that they can be easily opened to put in posters. The frames can be hung on the wall either vertically or horizontally.

5. Delivery & delivery times

Information on delivery times is not binding. black & schweiz always endeavors to adhere to the delivery times specified on the website. The product is produced upon conclusion of a contract. Unless otherwise agreed in writing, delivery is usually ex works from black & Switzerland. If, in exceptional cases, we are unable to meet the agreed deadlines, we will contact the customer by email or phone and the customer will get his money back.

The dispatch takes place with the Swiss Post. The goods must be checked for correctness, completeness and intactness immediately upon arrival. Transport damage must be reported and documented immediately, at the latest after five calendar days. black & schweiz endeavors to produce and deliver all ordered products as quickly as possible. The delivery time is usually 7-10 working days. As mentioned in Art. 1, deliveries are restricted to delivery addresses within Switzerland.  

In the event of delivery disruptions which were not culpably caused by black & schweiz and which black & schweiz cannot influence, we reserve the right to withdraw from the contract, provided that the obstacle to performance is not of a temporary nature without any obligation to pay compensation. This applies in particular to the effects of force majeure. We are not in default of delivery for the period of the hindrance. Services already paid will be reimbursed in the event of withdrawal.

As long as you are in default of payment, we will stop all services to you. Payments are offset against outstanding receivables, interest and outstanding costs in chronological order.

6. Payment terms

Shipping will only take place after the credit card or PayPal details have been checked. Payments can be made by credit card or PayPal. All prices are end customer prices that include packaging and shipping.

Additional shipping costs that arise due to the specification of incorrect delivery addresses or address data will be charged to the customer if he is responsible for the incorrect information.

7. OWNERSHIP

The goods remain the property of black & Switzerland until full and final payment and delivery.

8. Coupons

Vouchers are only valid for the specified period and can only be redeemed once as part of an online order process. The voucher cannot be paid out in cash. black & schweiz reserves the right to adjust discount campaigns or to withdraw them at any time.

9. Returns

The right of cancellation and return is excluded if the products are manufactured according to the customer's specifications and tailored to his personal needs (all products are manufactured “on demand” by black & Switzerland). For this reason, all photo products manufactured by black & schweiz are excluded from the right of return.

10. Links

black & schweiz can provide links to other websites over which black & schweiz has no control and companies over which black & schweiz has no control can provide links to the website. Even if black & schweiz tries to ensure that black & schweiz only provides links to websites that have similar provisions with regard to the protection of personal data and security as set out in black & schweiz's data protection guidelines, black & schweiz is not responsible for the protection or confidentiality of personal data Responsible for data provided by the customer on other websites. The customer should be careful and read the personal information policy that actually applies to the particular website.

11. Liability

black & schweiz excludes any liability for the products sold and delivered within the framework of the legally permissible provisions.

12. Final provision

All legal relationships are subject to Swiss law. black & schweiz reserves the right to change these general terms and conditions at any time. The place of jurisdiction is the registered office of black & Switzerland. The language available for the conclusion of the contract is German.
